This Washington Consumer Health Data Privacy Policy (“Policy”) describes the practices of the Pulmonary Hypertension Association (“PHA,” “we,” or “us”) for collecting, using, and sharing consumer health data of Washington residents or individuals whose consumer health data is collected in Washington (each, a “consumer”, as that term is defined in the Washington My Health My Data Act).
This Policy applies to consumer health data collected through the PHA website (phassociation.org), related platforms, mobile applications, registration forms, and other services linking to this Policy. This Policy does not apply to information that is exempt from the Washington My Health My Data Act, including protected health information under HIPAA, de-identified data, and publicly available information. We collect the following categories of consumer health data from and about you:
- Health conditions and diagnoses. Your type of pulmonary hypertension (PH Group 1–5), related diseases or conditions, year of diagnosis, and connection to pulmonary hypertension (e.g., patient, caregiver, family member).
- Treatments and medications. Current or prior treatments, prescribed medications, therapy methods, and oxygen use.
- Health insurance information. Primary and secondary health insurance types.
- Health care provider affiliation. Whether you receive care at a PH Care Center and, if so, which one.
- Data identifying a consumer seeking health care services. Information you provide in connection with peer mentorship, conference registration, scholarship applications, or other PHA programs that identifies you as someone seeking or receiving health care services related to pulmonary hypertension.
We collect and use the categories of consumer health data described above for the following purposes:
- Providing PHA membership services, programs, and resources you request, including peer mentorship matching, conference and event administration, and scholarship evaluation.
- Marketing segmentation and targeted outreach, including email campaigns and direct mail based on your relationship to pulmonary hypertension, location, and, where available, diagnosis information.
- Sending promotional or research-related emails on behalf of sponsors (e.g., pharmaceutical companies or research institutions) to targeted groups based on demographic and diagnosis information; PHA sends these emails directly and does not share your personal information with sponsors.
- Recordkeeping, auditing, and complying with legal obligations.
- Performing services and operations, including security, fraud prevention, and quality control.
We collect consumer health data from the following sources:
- Directly from you, when you create a PHA account, join as a member, register for events, apply for scholarships, participate in the Peer Mentor Program, or otherwise provide health-related information through our website, forms, or platforms.
We do not sell your consumer health data.
We may share consumer health data with the following categories of third parties and affiliates:
- Service providers and processors that help us operate our programs and services, including database management, email distribution, website hosting, and analytics providers. These providers are contractually required to use consumer health data only to perform services on our behalf and to maintain its confidentiality.
- Peer Mentor Program participants. If you participate in the Peer Mentor Program, certain health data you provide (including your pulmonary hypertension connection, treatments, areas of experience, chronic illnesses connected to pulmonary hypertension, and year of diagnosis) will be publicly shared so that patients can find mentors with relevant experience. You must consent to this disclosure to participate.
We may also share consumer health data as permitted by applicable law, including to prevent, detect, or respond to security incidents, identity theft, fraud, or other illegal activity, or to comply with legal obligations such as court orders, subpoenas, or law enforcement requests.
Under the Washington My Health My Data Act, you have the following rights with respect to your consumer health data:
- Right to Confirm. You may request confirmation of whether we are collecting, sharing, or selling your consumer health data.
- Right to Access. You may request access to your consumer health data, including a list of all third parties and affiliates with whom we have shared it and their contact information.
- Right to Withdraw Consent. You may withdraw your consent for our collection and sharing of your consumer health data.
- Right to Delete. You may request that we delete your consumer health data.
We will not discriminate against you for exercising any of these rights.
To exercise any of these rights, please contact us at web@phassociation.org We will respond to your request within 45 days of receipt. If additional time is needed due to the complexity of your request, we will notify you of an extension within the initial 45-day period. If we are unable to authenticate your identity using commercially reasonable efforts, we may request additional information before processing your request. You are not required to create a new account to exercise your rights. If your request is denied, you may appeal the decision by contacting us at web@PHAssociation.org, and we will respond to your appeal within 45 days.
